The exact scope of each project will be agreed separately.
3. Website Prices
Prices displayed on burt.digital, including prices described as “from”, are indicative starting prices.
The final price depends on the project's scope, functionality, integrations, content requirements and other relevant factors.
A personalised quotation or proposal may therefore differ from prices displayed on the website.
4. Quotations and Project Approval
Before starting a project, we may provide a quotation, proposal or written confirmation describing matters such as:
- scope;
- deliverables;
- price;
- payment schedule;
- estimated timeframe;
- revisions;
- additional services.
A project is considered accepted when the client confirms acceptance of the proposal or quotation and, where applicable, makes the required initial payment.
5. Payment
Payment terms will be specified in the relevant quotation, proposal or invoice.
We may require an advance payment before work begins.
Work may be divided into project stages with payments due at agreed milestones.
Third-party costs may be payable separately.
Work outside the agreed scope may incur additional charges.
6. Client Responsibilities
The client must provide information and materials reasonably required to complete the project, which may include:
- text;
- photographs;
- branding materials;
- product information;
- account access;
- domain or hosting access;
- platform credentials;
- feedback and approvals.
The client confirms that they have the necessary rights and permissions to use materials supplied to BURT Digital.
7. Project Timelines
Project timelines are estimates unless a fixed deadline has expressly been agreed.
The client acknowledges that delays in supplying content, credentials, feedback or approvals may affect delivery dates.
We are not responsible for delays caused by circumstances outside our reasonable control or by third-party platforms and providers.
8. Revisions
The number or scope of revisions included in a project may be specified in the quotation or proposal.
A revision means a reasonable adjustment to work within the previously agreed scope.
Requests that substantially change the structure, functionality, design direction or requirements of a project may be treated as additional work and quoted separately.
9. Additional Work
Features or services not included in the original scope may be charged separately.
Where practical, we will notify the client before undertaking material additional work that will result in additional charges.
10. Third-Party Services
Projects may rely on third-party products and services including:
- Shopify;
- hosting;
- domains;
- payment gateways;
- applications;
- plugins;
- themes;

- external software.
Unless specifically included in our quotation, third-party subscriptions, licences and other fees are the client's responsibility.
We cannot guarantee the continued availability, pricing, functionality or policies of third-party services.
11. Intellectual Property
The client retains ownership of materials supplied by the client.
BURT Digital retains ownership of its pre-existing intellectual property, processes, know-how, reusable components, methodologies, frameworks and development tools.
Following full payment of amounts due for a project, the client may use the final project-specific deliverables provided by BURT Digital for their intended business purposes, subject to applicable third-party licences.
Any alternative intellectual property arrangement may be agreed separately in writing.
12. Portfolio
Unless otherwise agreed in writing, BURT Digital may display completed public-facing work as part of its portfolio.
This may include:
- screenshots;
- project descriptions;
- links to completed websites;
- client or project names;
- descriptions of services provided.
Confidential information will not knowingly be disclosed.
A client may request that confidential or non-public work is excluded from our portfolio.
13. Website Launch and Acceptance
Clients should review a project before final approval or launch.
Following approval, material changes or new functionality may be treated as additional work.
Minor defects directly relating to the agreed scope that are identified within any support period specifically included in the project will be addressed in accordance with the project agreement.
14. Maintenance and Support
Website development does not include unlimited future maintenance unless an ongoing support service has been purchased.
After launch, changes resulting from:
- platform updates;
- third-party applications;
- client modifications;
- hosting changes;
- new browser or device requirements;
- new functionality requested by the client
may require additional work.
15. Cancellation
A client may request cancellation of a project.
Where work has already begun, payments relating to completed work, allocated project time and non-refundable third-party costs may not be refundable.
If the value of work completed exceeds payments already received, the outstanding amount may remain payable.
Any applicable refund will be assessed according to the project circumstances and the terms agreed with the client.
16. Results
We aim to provide professional digital services but cannot guarantee particular commercial results.
In particular, we do not guarantee:
- sales;
- revenue;

Business performance depends on numerous factors outside our control.
17. Limitation of Liability
BURT Digital will provide its services with reasonable care and skill.
To the extent permitted by applicable law, BURT Digital will not be responsible for indirect or consequential loss arising from third-party services, circumstances outside our reasonable control or use of services contrary to their intended purpose.
Nothing in these Terms excludes any liability that cannot lawfully be excluded.
18. Confidentiality
Non-public business, commercial and technical information disclosed during a project should be treated as confidential and used only for purposes reasonably connected with the project.
19. Governing Terms
Specific quotations, proposals or written project agreements may contain additional or different terms.
Where there is a conflict between these general Terms and a specifically agreed written project agreement, the specifically agreed terms will take precedence for that project.
20. Changes to These Terms
We may update these Terms from time to time.
The version published on burt.digital at the relevant time will be the current website version.
